Acting Somerset County Prosecutor Michael H. Robertson, acting Chief of County Detectives Timothy M. Fitzgerald, and Bernardsville Borough Chief of Police Kevin Valentine announce the arrest of James Tyrone, age 47, of Old Wood Road, Bernardsville, New Jersey.

Acting Prosecutor Robertson states that on May 8, 2016, at approximately 2:09 a.m. Bernardsville Police responded to a 9-1-1 call reporting an assault in progress at an Old Wood Road residence.  Dispatchers advised the patrols that the male suspect, later identified as  James Tyrone, was armed with a handgun.

Responding Bernardsville Police Sergeant Jon-Paul Tay and Patrolman Robert Schlittler encountered an injured 42 year old female who was bleeding from a head wound.  While attempting to remove the victim from the residence, the officers encountered defendant Tyrone, who aimed a handgun at Sgt. Tay and then retreated into the residence.

Once back inside the residence defendant Tyrone grabbed a 39 year old male friend who was visiting him.  Tyrone used his friend as a human shield while pointing the weapon at both officers and his friend. The defendant asked the officers to kill him.  As the defendant continued to threaten to shoot his friend and then himself,  the officers ordered Tyroneto drop his weapon as they told him they were not there to harm him.

After failing to drop the weapon, Tyrone aimed the handgun at his friend’s chest, and the victim was able to grab the gun from him.  The officers immediately proceeded to retrieve the fully loaded Walther P99, 9mm handgun, and place defendant Tyrone into custody without further incident.  The female victim was treated at the scene and transported to an area hospital for medical treatment.

Detectives from the Bernardsville Police Department in conjunction with detectives from the Somerset County Prosecutor’s Office Major Crimes Unit, and the Crime Scene Investigations and Forensics Unit responded to conduct the investigation.

Additional patrol units from Far Hills, Bernards Township, and Peapack-Gladstone responded to assist the officers at the scene.

Acting Prosecutor Robertson commends Sergeant Tay and Patrolman Schlittler for their timely response and heroic actions.  Faced with a deadly force encounter these officers demonstrated the utmost restraint and were able to successfully bring this event to a peaceful conclusion.

Defendant Tyrone has been charged with Possession of a Weapon for an Unlawful Purpose, 2nd Degree, Aggravated Assault, 3rd Degree, and Aggravated Assault, 4th Degree.

Defendant Tyrone was transported to an area hospital for observation.

The Honorable Kathy Qasim, J.S.C. set bail at $75,000 cash or bond with the condition that should the defendant post bail he is not to have contact with the victims.
