AGGRAVATED ASSAULT ON A LAW ENFORCEMENT OFFICER FRENCHTOWN

The Grand Jurors of the State of New Jersey, for the County of Hunterdon, upon their oaths present that Elliott T. Rose, on or about July 3, 2015, in the Borough of Frenchtown, in the County of Hunterdon, and within the jurisdiction of this Court, purposely, knowingly or recklessly did cause bodily injury to Patrolman Paul Murphy, a law enforcement officer of the Frenchtown Police Department, while the said officer was acting in the performance of his duties while in uniform or exhibiting evidence of his authority, contrary to the provisions of N.J.S.A. 2C:12-1b(5)(a), and against the peace of this State, the Government and dignity of the same.

The Grand Jurors of the State of New Jersey, for the County of Hunterdon, upon their oaths present that Elliott T. Rose, on or about July 3, 2015, in the Borough of Frenchtown, in the County of Hunterdon, and within the jurisdiction of this Court, purposely, knowingly or recklessly did tamper with tangible property of V.T., causing pecuniary loss in excess of $500.00 but less than $2,000.00, contrary to the provisions of N.J.S.A. 2C:17-3b(2), and against the peace of this State, the Government and dignity of the same.

The Grand Jurors of the State of New Jersey, for the County of Hunterdon, upon their oaths further present that Elliott T. Rose, on or about July 3, 2015, in the Borough of Frenchtown, in the County of Hunterdon, and within the jurisdiction of this Court, did threaten to kill Patrolman Paul Murphy, a law enforcement officer of the Frenchtown Police Department, with purpose to put the said victim in imminent fear of death under circumstances reasonably causing the victims to believe the immediacy of the threat and the likelihood that it would be carried out, contrary to the provisions of N.J.S.A. 2C:12-3b, and against the peace of this State, the Government and dignity of the same.

The Grand Jurors of the State of New Jersey, for the County of Hunterdon, upon their oaths further present that Elliott T. Rose, on or about July 3, 2015, in the Borough of Frenchtown, in the County of Hunterdon, and within the jurisdiction of this Court, purposely did prevent Patrolman Paul Murphy, a law enforcement officer of the Frenchtown Police Department, from effecting a lawful arrest by using physical force upon Patrolman Murphy, specifically by charging through a closed door, then wrestling Patrolman Murphy to the ground, creating a substantial risk of causing physical injury to the said law enforcement officer, contrary to the provisions of N.J.S.A. 2C: 29-2a (3)(b), and against the peace of this State, the Government and dignity of the same.

The Grand Jurors of the State of New Jersey, for the County of Hunterdon, upon their oaths further present Elliott T. Rose, on or about July 3, 2015, in the Borough of Frenchtown, in the County of Hunterdon, and within the jurisdiction of this Court, did knowingly enter the structure of V.T. at 12 Front Street, Frenchtown, New Jersey, without license or privilege to do so, with purpose to commit an offense therein, contrary to the provisions of N.J.S.A. 2C:18- 2a(1), and against the peace of this State, the Government and dignity of the same.
