MAN THREATENS TO KILL TROOPER ON 78

The Grand Jurors of the State of New Jersey, for the County of Hunterdon, upon their oaths further present that Eugene J. Burnham, on or about March 31, 2015, in the Township of Union, in the County of Hunterdon, and within the jurisdiction of this Court, did threaten to kill Trooper R. Fernandez, with purpose to put the said victims in imminent fear of death under circumstances reasonably causing the victims to believe the immediacy of the threat and the likelihood that it would be carried out, contrary to the provisions of N.J.S.A. 2C:12-3b, and against the peace of this State, the Government and dignity of the same.

The Grand Jurors of the State of New Jersey, for the County of Hunterdon, upon their oaths present that Eugene J. Burnham, on or about March 31, 2015, in the Township of Union, in the County of Hunterdon, and within the jurisdiction of this Court, did, while operating a motor vehicle on a street or highway of this State, knowingly flee or attempt to elude Trooper R. Fernandez, of the New Jersey State Police – Perryville, a police or law enforcement officer, after having received a signal from such officer to bring the motor vehicle to a full stop, thereby creating a risk of death or injury to any person, contrary to the provisions of N.J.S.A. 2C:29-2b, and against the peace of this State, the Government and dignity of the same.

The Grand Jurors of the State of New Jersey, for the County of Hunterdon, upon their oaths further present that Eugene J. Burnham, on or about March 31, 2015, in the Township of Union, in the County of Hunterdon, and within the jurisdiction of this Court, did with purpose to hinder his own apprehension, prosecution, conviction or punishment for an offense, flee from a motor vehicle stop and attempt to hide in a wooded area in an effort to conceal himself from State Troopers, knowing that he had two outstanding traffic warrants for his arrest, contrary to the provisions of N.J.S.A. 2C:29-3b(1) and against the peace of this State, the Government and dignity of the same.

The Grand Jurors of the State of New Jersey, for the County of Hunterdon, upon their oaths further present that Eugene J. Burnham, on or about March 31, 2015, in the Township of Union, in the County of Hunterdon, and within the jurisdiction of this Court, purposely did obstruct the detection or investigation of a crime, by means of flight, intimidation, force, violence or physical interference or obstacle or by means of any independently unlawful act, contrary to the provisions of N.J.S.A. 2C:29-1b, and against the peace of this State, the Government and dignity of the same.
