NOT A FABULOUS IDEA TO DRIVE INTO A DUI CHECKPOINT WITH AN OPEN CONTAINER

On Thursday, July 2, at approximately 10:35 pm, Patrolman Drew MacQueen was working a D.W.I. checkpoint on Route 31 North near Halstead Street when he approached a 2010 Nissan Altima operated by Augusto Hernandez, age 36, of Califon. As he did, Ptl. MacQueen observed opened cans of beer inside of the vehicle, detected the odor of an alcoholic beverage, and soon determined that Mr. Hernandez was intoxicated. Mr. Hernandez was arrested and transported to police headquarters where he provided samples of his breath for chemical testing to determine the content of alcohol in his blood. Ptl. MacQueen charged Mr. Hernandez with Driving While Intoxicated and Consumption of an Alcoholic Beverage While Operating a Motor Vehicle. He was released to the custody of a responsible adult and his vehicle was towed and impounded.
